Terms & Conditions

The terms governing your use of the Tekigami website and your engagement with Tekigami for digital products, technology services and related work.

Effective: To be confirmed before publicationLast updated: September 17, 2026

These Terms & Conditions govern your access to and use of the Tekigami website and, where applicable, your engagement with Tekigami for digital products, software, automation, AI, 3D experiences, consulting, maintenance and related technology services.

These terms are an implementation draft and should be reviewed by a qualified legal professional before being published as the final contractual terms.

1. About Tekigami

Tekigami is a digital solutions studio providing technology, development, design and related digital services to businesses, organizations and other clients.

The specific services provided to a client will depend on the applicable proposal, quotation, statement of work, order, subscription or separate service agreement.

2. Acceptance of These Terms

By accessing or using this website, you agree to comply with these Terms & Conditions.

If you do not agree with these terms, please do not use the website.

Where Tekigami enters into a separate written agreement with a client, that agreement will govern the relevant services to the extent that its provisions conflict with these website terms.

3. Website Use

You may use the website for lawful purposes and in accordance with these terms.

You must not:

  • Use the website for unlawful, fraudulent or malicious purposes
  • Attempt to gain unauthorized access to systems, accounts or data
  • Introduce malicious code, malware or other harmful material
  • Interfere with the operation or security of the website
  • Copy, reproduce or exploit website materials without appropriate permission
  • Misrepresent your identity or authority when communicating with Tekigami

4. Eligibility

You must have the legal capacity required under applicable law to use the website or enter into a service agreement with Tekigami.

If you are acting on behalf of a company or organization, you represent that you have authority to act on its behalf.

5. Intellectual Property

Unless otherwise stated, the Tekigami website, including its branding, text, graphics, designs, interfaces, source materials and other original content, is owned by or licensed to Tekigami.

Nothing in these terms grants you ownership of Tekigami's intellectual property unless expressly agreed in writing.

6. Client Content

If you provide Tekigami with text, images, logos, documents, data, software, designs or other materials, you remain responsible for ensuring that you have the necessary rights and permissions to provide and use those materials.

You grant Tekigami the permissions reasonably necessary to use client-provided materials for performing the agreed services.

7. Enquiries and Proposals

Submitting an enquiry through the website does not automatically create a client relationship or service contract.

Project scope, deliverables, timelines, pricing and responsibilities will be confirmed through the applicable proposal, quotation, statement of work or service agreement.

8. Project Scope and Changes

For commissioned work, the agreed scope will identify the services and deliverables to be provided.

Requests outside the agreed scope may require additional fees, revised timelines or a separate agreement.

9. Client Responsibilities

Clients are responsible for providing accurate information, appropriate content, required access and timely feedback where these are necessary for the performance of a project.

Delays caused by missing information, approvals, credentials, materials or client decisions may affect project timelines.

10. Payments and Fees

Project fees, subscription fees, payment schedules and applicable taxes will be specified in the applicable proposal, quotation, invoice or service agreement.

Unless otherwise agreed in writing, work may be dependent on required payments being received when due.

11. Subscriptions and Renewals

Where Tekigami provides services on a subscription basis, the applicable subscription agreement will specify the price, billing frequency, included services, renewal terms and cancellation requirements.

A subscription does not automatically include work outside the services described in the applicable plan or agreement.

12. Cancellation

Cancellation terms for a project or subscription will depend on the applicable agreement.

Clients should review their proposal, order, subscription terms or service agreement for any notice periods, outstanding payment obligations or cancellation requirements.

13. Refunds

Refund eligibility depends on the applicable service agreement, proposal or purchase terms.

Because digital services and commissioned development work may involve work performed specifically for a client, refunds are not guaranteed unless expressly provided for in the applicable agreement or required by applicable law.

14. Delayed Payments

If an amount becomes overdue, Tekigami may suspend or pause applicable services after providing any notice required by the applicable agreement or law.

15. Third-Party Services

Projects may depend on third-party platforms, APIs, hosting providers, software libraries, infrastructure or other services.

Tekigami is not responsible for outages, policy changes, pricing changes, security incidents or discontinuation of third-party services outside Tekigami's reasonable control.

16. AI-Generated Outputs

Some Tekigami services may use artificial intelligence, machine learning models or automated systems.

AI-generated outputs may contain errors, omissions, inaccuracies or unexpected results and should be reviewed by an appropriate human before being relied upon for important decisions.

Unless expressly agreed otherwise, Tekigami does not guarantee that AI-generated content will be unique, error-free or suitable for every intended purpose.

17. Software and Digital Products

Software, websites, applications, dashboards, automation systems and other digital products may depend on technical infrastructure, browsers, operating systems, APIs and third-party services.

Compatibility and functionality may change as these underlying technologies evolve.

18. Website Availability

Tekigami aims to keep the website available and functional but does not guarantee uninterrupted or error-free availability.

The website may occasionally be unavailable because of maintenance, upgrades, technical issues, infrastructure problems or circumstances beyond Tekigami's reasonable control.

19. Disclaimers

Website content is provided for general informational purposes. Unless expressly agreed in writing, information on the website does not constitute professional, legal, financial, medical or other regulated advice.

Service-specific warranties, if any, will be described in the applicable written agreement.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Tekigami will not be responsible for indirect, incidental, special, consequential or loss-of-profit damages arising from use of the website or services.

Any limitation of liability is subject to applicable law and to the specific terms of any agreement entered into with a client.

21. Indemnification

Where permitted by applicable law, you agree to be responsible for claims arising from your unlawful use of the website, violation of these terms, or materials that you provide to Tekigami where those claims result from your breach of applicable rights or obligations.

22. Confidentiality

Confidential information exchanged during a client engagement should be handled according to the applicable service agreement or confidentiality agreement.

These website terms do not replace a separately executed confidentiality or non-disclosure agreement.

23. Termination

Tekigami may restrict or terminate access to the website where reasonably necessary to protect the website, its users, its systems or its legal rights.

Termination of a client engagement will be governed by the applicable project or service agreement.

24. Changes to These Terms

Tekigami may update these Terms & Conditions when its website, services, business practices or legal obligations change.

The updated version will display a revised "Last Updated" date.

25. Governing Law and Disputes

The governing law, jurisdiction and dispute-resolution process for a client engagement should be specified in the applicable written agreement.

Where no separate agreement applies, the governing law and jurisdiction should be confirmed by Tekigami's legal counsel before this section is treated as final.
